I really don't see what the big deal is....
When I was in school there was a no drug policy, period. You were not to have any drugs on your person on school grounds of any type be it over the counter, prescription, or illegal. If you needed medication during the day, your parent or guardian is supposed to make arrangements with the School Nurse and place said medication into their care, not the care of the child.
Now if this school has a similar policy then:
Girl #2 got sick as a direct result of girl #1's refusal to comply with school policy in addition to distributing a control substance to a minor without the consent of that's child's parents and is therefore guilty of a punishable crime no matter how insignificant any of us label this incident to be.
You either set a standard, stick to it, and punish all violators equally or you start making exceptions, which is commonly referred to as discrimination
